FCA Business Interruption Insurance test case – good news for policyholders

Judgment was handed down today in the business interruption insurance test case brought by the FCA, with the findings generally being positive for policyholders.

The Court found that most of the relevant clauses provided cover to the insureds, and gave helpful guidance in relation to the critical issue of causation in particular.

A spokesman for the FCA said they were “pleased that the Court has substantially found in favour of the arguments we presented on the majority of the key issues”. It also asked that insurers “consider the steps they can take now to progress claims of the type that the judgment says should be paid”.
