Colin Young, Litigation Partner, Boodle Hatfield

Colin acts on a wide range of property and commercial matters. He has particular experience in property litigation matters for landlords, tenants, freeholders and developers.

This includes strategic property management advice, breaches of covenant, rent recovery, contentious rent review, dilapidations, contentious assignments and alterations, lease renewals, both contested (especially to free up sites for development) and uncontested, trespass, tenant insolvency and forfeiture / surrender of leases.

His other areas of work include commercial disputes and licensing.

Track Record

Acting in a major redevelopment in the West End of London. This involves coordinating termination of a number of leases both commercial and residential. The commercial leases include heavily contested proceedings under the Landlord and Tenant Act 1954

A £60 million partnership dispute about a hotel development. The claim was expedited through the Courts. Our interpretation of the contracts was approved by Court of Appeal within 8 months of the claim being issues in the lower courts

Heavily contested proceedings concerning a basement development in Holland Park. This is one of a number of claims concerning basements in recent years. Colin has acted for both developers and neighboring landowners in this highly topical area of law

Acting for a group of leaseholders in dispute with a pensions company of a large media organisation over the interpretation of a rent review clause. The alternative interpretation if the clause would have resulted in drastic rent review increases for leaseholders. Our arguments prevailed, with around 200 revised deeds now being put in place

Acting on several claims under the Landlord and Tenant Act 1987 where Freeholders have failed to follow correct proceedings when assigning other interests
